EU Regulation 2016/679 – European Parliament and Council, April 27, 2016 (General Data Protection Regulation)

The aforementioned regulation governs the protection of personal data and imposes a series of obligations on those who process such data. Among the obligations to be met is the requirement to inform the individual to whom the data relates.

Given the above, we inform you that the website you are currently browsing (hereinafter referred to as the ‘Site’) is owned and operated by Labinf Sistemi S.r.l., with registered office at Viale Milanofiori, Strada 1 Palazzo F/1 – 20057 ASSAGO (MI).

As browsing the Site by users involves the processing of personal data, we hereby inform you about the data related to you that will be collected, the purposes and methods of processing, and, in general, everything else provided in your interest by Article 13 and subsequent articles of Regulation (EU) 2016/679 (GDPR), which came into effect on May 25, 2018 (hereinafter referred to as the ‘Regulation’). Therefore, we inform you that:

Identity and contact details of the data controller

According to the Regulation, the data controller (hereinafter ‘Controller’) is the entity that, either alone or jointly with others, determines the purposes and means of the processing. In this case, the Controller is Labinf Sistemi S.r.l., with registered office at Viale Milanofiori, Strada 1 Palazzo F/1 – 20057 ASSAGO (MI), VAT number 12552470150, and Tax Code 00532510070, privacy@labinfsistemi.it.

Purposes of personal data processing and legal basis for processing

The personal data you provide or will be requested to provide are necessary for the following purposes: General purposes a) Allow you to navigate through various sections of the website and optimize your interactions with it; b) Respond to technical support or commercial inquiries sent by you and keep a database of frequently asked questions, proposals, and communications; c) Collect your contact information, provided through a specific form, in order to be able to contact you. d) Manage additional aspects of navigation (see also the ‘cookie policy’ section); e) Select, evaluate, and research personnel for our organizational structure; f) Support commercial and administrative management in customer relations; g) Fulfill any legal obligations and requirements; h) Non-automated customer qualification;

The legal basis justifying the processing is determined by the applicable laws, particularly Article 6 of the Regulation. Please note that, if the processing of personal data for these purposes is deemed indispensable (Article 6, paragraph 1, letter a), consent to the processing of personal data for these purposes is not mandatory. However, failure to provide such data may, in fact, prevent you from accessing the services offered by the website.

Direct marketing purposes Marketing activities through the sending of promotional and advertising material related to products or services, via mail, email, telephone, newsletters, and similar means. Furthermore, please note that if you no longer wish to receive such communications, you can make an explicit request using the contact details provided in this notice. In particular, please note that the newsletters and emails you receive will contain a specific link to send a direct request to be excluded from the respective mailing list;

The legal basis justifying the processing is determined by the applicable laws. In particular, we inform you that your personal data may be processed for the above purposes only with your freely given, optional, and revocable consent, except for the case provided for in Article 130, paragraph 4 of Legislative Decree no. 196 of June 30, 2003.

Profiling purposes For profiling purposes, i.e., to analyze your preferences and interests and propose personalized services, content, initiatives, and offers to you (by ordinary mail, telephone calls, email notifications, applications, and newsletters); after having voluntarily expressed consent, it is your right to oppose, at any time and without cost, the processing of your data for this purpose using the contact details provided in this notice.

Nature of personal data

The personal data subject to processing are those that will be used for the purposes indicated in Chapter 3. The personal data collected mainly relate to:

a) Identifying information of individuals (personal data, contact information, etc.); b) Navigation data received as a result of your interactions with the Web-App (technical cookies), such as user recognition, language, and session storage. These are pieces of information that are not collected to be associated with you but, by their nature, could, through processing and associations with data held by third parties, allow identification of the person to whom they refer. This category includes data such as the time and date of access, IP addresses, and the location of the devices used for access, queries made to the Web-App, and responses provided by the Web-App during its use. Please refer to the relevant cookie policy. We clarify that if you consent to the use of cookies, your data will also be processed by third parties, Google, in accordance with the aforementioned cookie policy.
Recipients or categories of recipients of personal data

The data in question will not be ‘disclosed,’ i.e., will not be made known to indeterminate subjects, except with your explicit authorization. However, for exclusive organizational reasons, they will be made known to subjects designated as data processors, namely, the employees of the Controller, as well as third parties such as collaborators and suppliers of the Controller (e.g., technical and technological service providers, hosting services, assistance and maintenance services, as well as credit institutions and banks) for services related to the services offered by the Site and any partners of the Controller, who will be appointed as data processors pursuant to Article 28 of the Regulation.

Transfer of personal data to a third country or to an international organization

Your data will be processed primarily in Italy and in states that are part of the European Union. However, to pursue the processing purposes described, it may be necessary to transfer data to non-EU countries. Any transfer of your data to other countries will comply with the provisions of Articles 44 and following of the Regulation.

Period of personal data retention/criteria used to determine this period

The processing will be retained for the period strictly necessary to achieve the purposes for which it was collected, until the possible withdrawal of consent or within the maximum terms allowed by law when the continuation of processing is necessary to fulfill legal obligations or orders given by Public Authorities and/or Supervisory Bodies. After this period, the data will be destroyed or anonymized.

Exercisable rights

It is specified and reminded that, in addition to being able to lodge a complaint with the Supervisory Authority, you may exercise a series of rights provided by current legislation, which are summarized below: Article 15 – right of access by the data subject; Article 16 – right to rectification; Article 17 – right to erasure (‘right to be forgotten’); Article 18 – right to restriction of processing; Article 20 – right to data portability; Article 21 – right to object; Article 22 – right not to be subject to automated decision-making, including profiling.

Non-mandatory nature of providing data

Providing personal data is not mandatory by law. However, as is easy to understand, providing such data is essential to fulfill the processing described in Chapter 3 and, therefore, the refusal to provide personal data may effectively make it impossible to provide the services offered by this Site.

The contents of the website are the property of Labinf Sistemi S.r.l.; and are subject to copyright with all rights reserved. The website, being ‘works of creative intellect…’ constitutes an object of copyright (Article 2575 of the Italian Civil Code) and as such belongs to the author or to those who have acquired the rights. Therefore, it is allowed to download or print a copy of individual pages or sections of the website provided that the copyright or other notes related to reserved ownership are not removed. Downloading or making copies from the website will not transfer any ownership rights to any software or materials.
